The Polish game developer Spribe has expressed concern about third parties approaching its client base to share a game with characteristics similar to their 'Aviator' product. According to Spribe, PopOk Gaming has been distributing a pseudo version of the game to capitalize on the popularity of their original version. According to a statement on January 1st by Spribe, “Our data shows that unlicensed parties are contacting selected clients offering an 'Aviator' game with a comparable design and concept, representing it as the genuine Aviator game. PopOk Gaming's illegal gambling operation is just one of several fraudulent activities.”
According to Spribe, these practices are deceptive and do not meet the operator’s expectations, damaging corporate brand integrity. PopOk Gaming is taking advantage of Spribe’s existing reputation and customer network. This situation has triggered worries about financial losses and negative impacts on Spribe's market standing, driving the company to take immediate corrective measures.
PopOk Gaming's Rebuttal
PopOk Gaming declared its position as the "official provider of Aviator" in a public announcement on January 20. The company made the game available through its extensive network of partners. This indicated a collaboration between PopOk Gaming and Spribe, with the Aviator Crash game holding much significance to PopOk, as indicated by Tsovinar Elchyan, who leads partner management at the company. In a statement, he reaffirmed, "We are delighted to join forces with Aviator, a game that is a sensation worldwide. Our integration of this game into PopOk Gaming's platform will lead to enhanced value for both partners and fascinating gameplay for users.”
The 'Aviator' game logo and graphics are prominent on PopOk Gaming's official website and social media platforms. However, the licensing status between PopOk Gaming and Spribe is unclear, as the company's "official provider" label does not have official validation. The unclear partnership terms have intensified the dispute, which continues to attract attention from major industry players who now seek clarification.
The Legal Implications
Spribe demanded that its business partners check their platforms for unlicensed 'Aviator' game versions while requesting the immediate uninstallation of identified unauthorized copies. Scribe made it clear through warning statements that protecting its intellectual property carries legal consequences for any operator or partner distributing unauthorized versions of their original games. “Our organization is treating this situation with extreme importance because we do not permit violations of intellectual property rights. The games published by PopOk breach our rights, and any party hosting or distributing these games can face legal consequences because they violate our rights.”
